Highly Skilled Migrants and market conform salary: successful objection procedure

De Vreede Advocaten lodged an objection against the decision of the Immigration Services (“IND”) to reject a Highly Skilled Migrant permit. The IND had rejected this application based on the advice of the Labour Authorities (“UWV”) that the migrant’s salary was disproportionately high compared to the salary earned by people with similar job titles. De Vreede Advocaten successfully argued that the UWV should not only look at the job title itself, but also at the tasks that were agreed upon, the education and experience of the migrant and the position of the migrant within the company. Based on these arguments, the IND reversed its previous decision and has granted the Highly Skilled Migrant permit.
